The subject of this agreement is the photographic service offered by Aleksandra Slowikowska (Alex Oss Photography). Booking the photoshoot means that You- The Client and me, the Photographer have read and fully accept the terms and conditions. This legally binding contract represents the entire understanding of the requirements, schedule and payments terms of a photo session. Failure to understand the language contained in terms and conditions is not grounds for braking the contract with Alex Oss Photography.
Payments and returns
a) A £30 deposit is taken on booking. This secure Your slot with me. This is a non- refundable deposit and if You cancel or reschedule the session for any reason You will lose Your deposit.
For all sessions excluding newborn photoshoots and outdoors- deposit is necessary as I cooperate with an external company that rents the space for duration of the photoshoot also requires deposit. If Client wish to book a new session date will be required to pay and additional £30 of deposit.
Your £30 deposit is taken off the total amount owing for the session. The remaining amount is payable on the day of the photo session. Until £30 deposit is paid, your booking is not secure and the photographer reserves the right to book anyone else in for the certain slot.
b) Payment can be made by cash , PayPal or bank transfer. Payment must be paid by date of the photo shoot at the latest. Any photos taken will not be released until payment is made.
c) All photographs shall be previewed and downloaded by Client via an online gallery. Because is a digital files and not a physical product, unfortunately no returns can be made.
d) If photographs are unable to delivered ( memory card error, issues outside of human error), a full refund will be made or another session scheduled, including 3 extra images in Client's gallery as compensation.
e) The price list is accessible to the general public on the website. It is presumed every Client is in receipt of and has read the price list, Alex Oss Photography cannot be responsible for Client's failure to read price list prior to the session.
f) If Client fails to read the supplied messaged with preparatory information, and therefore fails to carry out required preparations prior to a session, Alex Oss Photography will not be held responsible for any resulting reductions in quality or quantity of images supplied.
Cancelation
a) To cancel or reschedule for any reason, Client must give at least 7 days notice.
b) No shows are unacceptable and result in loss of my time and earnings for me and will, unfortunantely, affect any future booking with me.
Photoshoots take approximately 30 min to 2 hour ( excluding newborn photo shoots) and the schedule is tight in according to other Clients so any late arrival of over 15 minutes will result in a cancelation. Rescheduling is available after paying £30 of booking fee again.
Liability
The Client remains responsible for any children or adults which attend the session with them. As I use expensive equipment during my sessions, should the Client or any guest who come with the Client , break or damage any property, the Client is responsible for reimbursing the cost of replacement or repair of any equipment damaged.
Copyright
All photographs are and shall remain the sole intellectual property of Photographer. Please DO NOT amend, crop or change any aspect of Your images. The Client has printing right on any digital photographs purchased and can upload any of the images on social media.
You can not use unpaid photos from online gallery (screen shots etc.) with or without water mark on them!
Session
a) It is not possible to combine sessions, for example a Christmas session with birthday photos, or a newborn session. In this case, you must purchase the right package. Small babies must sit on their own or must be secured by a guardian during the session. Please take into consideration, that any other child attend on the photoshoot than brother or sister will be counted as separate session.
b) The images on this site are from large number of sessions and it is not possible to offer every pose or set up in each session. Every session is unique to each Client. If a particular pose, prop or photo is wanted, the Client will discuss any request before the day of the session.
c) The Photographer will make every effort to comply with request for specific photos. However, this will be dependant on the willingness/ co- operation of subjects, it may not be possible for all or may of the images requested or expected to be captured.
d) In the event of un unsettled Baby, some requested props or poses may not be suitable and the Photographer will use alternative props or poses. Please note, not all poses and shots are guaranteed. My priority during the session is to take pictures of the baby. When the baby is sleeping, or is awake but calm and wants to cooperate, I focus on getting as many shots as possible. Family photos are includes in midi and maxi package, but when the baby stops cooperating, I cannot guarantee all planned family poses.
e) The Photographer will do everything she can to produce the best quality images. However, if Your Baby won't settle or co- operate resulting in little or no images taken then the Photographer can not be held responsible. In this instance the Photographer will offer to chance to re-shoot at a time suitable for both parties, although for newborn sessions it cannot be guaranteed that it will be in the 2 weeks time frame.
f) Client must inform me on booking if anyone attending photography session suffers any health conditions including allergies, photosensitive epilepsy, medical issues, physical difficulties and disabilities etc. If Client is taken ill by an infectious disease, they must let me know asap to let me rearrange their session until they are fully recovered. This is to protect my all Clients, especially newborns.
g) On one photo session can be maximum 4 people in total.
h) Cameras, mobile phone cameras are not permitted during any session to take photos or video of the set up and/or the child on their own. Alex Oss Photography does not allows clients to take 'behind the scenes photos' of the photographer working. It may disrupt the photographer's work.
i) Photo session outside Basildon at the customer's request is additionally charged. The price depends on the distance but minimum is £15.
j) Client will be asked whether images can be shared on social media or website at time of session.
k) Alex Oss photography offers basic retouching (lighting correction, skin tones, larger imperfections on the skin). I do not add or correct make-up, flying hair. Before the session, please take care of your impeccable appearance. Make sure you look clean and tidy, take care of your appearance, clean and ironed outfit, aesthetic makeup, clean hair and nails. This type of retouching and also requests about interference with the appearance of the body in photoshop is extra charged- £30 per photo.
l) Package that includes 5, 10 or 20 photos does not necessarily mean 5, 10 or 20 different setups/poses made during the session. The number of setups/poses made during the session can vary depending on the photographer, baby's cooperation and the package offered.
Delivery
a) Unedited images to select will be delivered to the Client via an online gallery up to 2-3 working days from the date of the photo session. All images are protected with watermarks as they are released only for selection purpose. Proofing gallery is valid for 48 hours and if selection is not made by then, Photographer will choose which images to edit.
b) The photos that are released are chosen by me according to the number of photos that the Client ordered.
c) Uploading edited photos will be delivered up to 15 working days from selecting photos from the gallery. Online gallery will be available to view the images for 3 months from release date.
d) Please note that unedited images are not included in any package, but You can buy all unedited photos from your online gallery ONLY when you choose MAXI package for extra £100 or £150 depends on the session type.
e) Prints are included in Midi and Maxi package. Each additional prints cost £3. Client will be asked about prints preferences- they can be in colour or black and white. In mini package minimum order is 5 images to print. Alex Oss Photography is not responsible for the quality of the prints if the Client decides to print photos in a place ( like a photobooth in supermarkets etc.) other than the professional photo lab chosen by the photographer. Waiting time for prints is up to 45 working days. Prints included in packages are copies of the digital files the client chose with their package- prints are not an additional pictures. Prints need to be collected by the Client, or they can be send via post for extra charge- £7.50.
f) USB stick is a method of delivering the files to you if you have chosen the Maxi package or you purchased it additional to your package. USB stick includes only digital files the client chose with their package. USB stick isn't intended as permanent storage. It is solely Client's responsibility to back up the images and make enough copies for the images to be stored safely. Alex Oss Photography cannot be held responsible for loss of images due to failure to care for USB stick and/or back up images.
g) Alex Oss Photography can only guarantee that when the USB stick leaves the studio it is in perfect working order and expect any technical issues to be addressed to Alex Oss Photography within 48 hours. After this time Alex Oss Photography cannot be held liable for complications with the USB stick that may or may not be caused by Client's computer hardware. Alex Oss Photography cannot be held responsible for Client printing their own images, cannot be held liable for images looking a different colour, crop etc.
h) All non-purchased images are kept for 3 months. After that period they are deleted.
Model release
Being able to share the photographs I capture is an essential part of running a photography business- after all seeing my works is usually one of the main reason Clients book me.
Gift Vouchers
Gift Vouchers purchased from Alex Oss Photography are only valid for 12 months from date of purchase. Voucher can not to be exchanged for cash and are not transferable. No refunds will be given.
